Welcome to our website!

Every purchase of items on the NOWA MARKET website is subject to these General Terms and Conditions of Sale ("GTCS") which the Buyer declares to accept without reservation.  They have been in force since 4 October 2021 and were revised on 14 February 2024.

1.Ordering
The Buyer places an order on the NOWA MARKET website by following the procedure indicated. NOWA MARKET's automatic recording systems are considered as proof of the nature, content and date of the order. The confirmation of the online order constitutes an electronic signature which has the same legal value between NOWA MARKET and the Buyer as a handwritten signature. The sale will only be concluded once NOWA MARKET has confirmed the order. This confirmation includes: a summary of the order; if applicable, a paid invoice subject to acceptance of the bank transaction by the Buyer's bank. NOWA MARKET reserves the right not to confirm an order for any reason. In the event of a product withdrawal or recall procedure, NOWA MARKET must inform the customer as soon as it receives the information from the producer concerned. A communication will be sent by email to the customer indicating not to consume the product and NOWA MARKET will proceed to a refund on the payment method used or via a credit on the account. It is also possible that, due to the specificity of the product supply, some products ordered cannot be delivered in time. NOWA MARKET will inform the buyer of this and offer him an alternative product, a refund of the product or a credit on his next order. 

2. Order cancellation and refund
For any validated order, the buyer can ask NOWA MARKET to cancel and refund his order up to 24 hours before the selected delivery time.
The buyer cannot cancel an order already validated on his customer account. He must contact NOWA MARKET's customer service at [email protected] so that NOWA MARKET can cancel and refund his order. 

3. Right of withdrawal
The customer has the right to withdraw from the contract within 14 calendar days of receipt of the order without penalty and without giving any reason. The customer may submit his request by e-mail to the following address: [email protected].  He may request an exchange of the products or a refund. An exception concerns all fresh perishable products (all products in the fruit and vegetable and dairy categories on our site), the consumer therefore has no right of withdrawal for these products as referred to in art. VI. 53, 4° CDE ("supply of goods likely to deteriorate or expire rapidly"). If the order includes several goods and one or more of these goods are perishable: - The right of withdrawal does not apply to perishable goods according to Art. The right of withdrawal does not apply to perishable goods according to Art. VI. 53, 4° CDE; - But the right of withdrawal does apply to other goods (unless another exception of Art. VI. 53, 4° CDE applies) The buyer also has no right of withdrawal for "the supply of sealed goods which cannot be returned for reasons of health protection or hygiene and which have been unsealed by the consumer after delivery. During the withdrawal period, the customer shall take the utmost care of the products and their packaging. The customer is recommended to return the products in their original condition and packaging as well as in their unopened or undamaged packaging to the following address NOWA MARKET SRL, 4 RUE DIEUDONNE LEFEVRE 1020 LAEKEN. The return of the products must be done within a maximum of 14 days from the date of exercising the right of withdrawal and the return costs are at the customer's expense. NOWA MARKET will reimburse all payments received from the consumer when placing the order, including delivery costs. The company will refund the customer using the same payment method the customer used to place the order. The refund will be made within 14 days after NOWA MARKET has taken cognizance of the withdrawal request, provided that NOWA MARKET has received the returned products or that the customer has provided proof of their shipment. The customer is liable for any handling of the products other than that necessary to establish the nature and characteristics of the products. 4. Prices
The prices are indicated in euros, including VAT and are only valid on the date the order is placed. These prices can be modified at any time and do not include, if applicable, deposit fees and delivery fees, which are invoiced in addition. Only the price displayed on the NOWA MARKET website is binding between the parties.
The photos and other illustrations used to present the products are not binding and may show products or elements that are not included in the proposed price.

5. Payment
To pay for his order, the Buyer has the payment methods indicated when placing the order. Online payment allows the Buyer to pay his order via the MULTISAVEPAY payment platform, in a secure environment. NOWA MARKET reserves the right to cancel or suspend any order and/or any delivery as well as to block a customer account in case of :

Refusal to authorise payment by the Buyer's bank or in the event of an existing commercial dispute with the Buyer.
Fraudulent creation of several customer accounts. It is only possible to create 1 customer account per email address.
Fraudulent use of coupon codes. NOWA MARKET promo codes are not cumulative.
In the case of a payment by coupon code, if the amount of the order is lower than the amount of the coupon code used, the rest of the amount will be automatically lost.

6. Delivery costs, delivery times and delivery methods
All orders placed on NOWA MARKET must be at least 25€.  Per order, the delivery in points of deposit amounts to 2,00 €. These expenses cannot be disputed by the Buyer since he has necessarily taken note of them during the payment of his order. The items are delivered to the place indicated by the Buyer when placing the order. NOWA MARKET can only guarantee the freshness and availability of the order on the selected delivery day and during the opening hours of the depot specified on the NOWA MARKET website and in the delivery confirmation email received by the Customer.  
In the event of a significant delay in delivery by NOWA MARKET, if the Buyer is no longer available to be delivered outside of the initially selected delivery slot, a re-delivery or a refund will be offered. NOWA MARKET will not be liable for any late delivery charges or interest.  The buyer is advised to check whether he has received his order on the selected delivery day, as well as the condition of the packaging of the goods. It is suggested that the buyer notifies NOWA MARKET of any delivery problems by e-mail to the following address: [email protected] within 48 hours of receiving the delivery.

7. Money deposit 
For NOWA MARKET containers, we ask for a deposit which varies between 0,10€ and 1€ per container. When you return one or more containers, the deposit will be credited to your NOWA MARKET account within 48 hours after NOWA MARKET has received them.

8. Personal data
The Buyer's personal data are processed in accordance with the RGPD regulation of 27 April 2016 on the protection of privacy with regard to the processing of personal data. NOWA MARKET's policy is explained in the "data protection" tab.

9. Compliance
NOWA MARKET is bound by the legal guarantee of conformity of consumer goods under the conditions of articles 1649bis to 1649octies of the Civil Code. NOWA MARKET is liable to the buyer for any lack of conformity that appears within two years of delivery of the goods. The photographs illustrating the online catalogue are not contractual and may be modified at any time. NOWA MARKET cannot be held responsible for a non-conforming and/or erroneous photograph. NOWA MARKET provides the buyer with the best estimate of the weight of the product, taking into account the specificity of the type of product there may be a slight positive or negative variation.  If the weight varies by more than 10% against the customer, NOWA MARKET undertakes to reimburse this difference either by a credit on the customer's account allowing him to deduct it from his next payment on the NOWA MARKET website, or by a reimbursement directly to his bank account. NOWA MARKET undertakes to reimburse the product if its use-by date is exceeded upon receipt of the product, subject to receiving photo proof from the Buyer.

10. Complaints
Any complaint about an online purchase must be made within 2 months of the day the consumer noticed the defect. It is suggested that the buyer makes any claim within 4 days from the time of delivery of the order. It is recommended to send any complaint by e-mail to the following address: [email protected] and to include the references of the item concerned, the precise reasons for the dispute and a photograph of a specific item if requested by NOWA MARKET. In the event of an unresolved dispute, the buyer may apply to the European Commission's online dispute resolution service ODR.

11. Contractual changes
Any modification of the general terms and conditions of sale is opposable to the Buyer within 72 hours of their publication online.

12. Responsibility
The Buyer is informed that NOWA MARKET's liability, whatever the nature of the loss, will in any case be limited to the total amount of the order (including any delivery and order preparation costs). In case of non-performance, NOWA MARKET cannot be held responsible if the non-performance of the sales contract or its poor execution is attributable either to the Buyer, or to the unforeseeable and insurmountable act of a third party unrelated to the sale, or to a case of force majeure. Furthermore, NOWA MARKET cannot be held responsible for any damage, direct or indirect, resulting from the use of the item sold. NOWA MARKET is in no way responsible for interruptions in access to its site and for the consequences that may result. NOWA MARKET can never be held responsible for temporary or permanent damage or incidents that may be caused to the user's data or computer equipment when accessing the site or visiting its pages, or generally when the files and software that make up the site are transmitted to his or her receiving device. In particular, NOWA MARKET is not responsible for the possible transmission of viruses through its site. EFARMZ is not responsible for the fraudulent use of its means of distribution and declines all responsibility in the event of intrusion into its computer systems and theft of data, it being understood that NOWA MARKET implements the necessary means to prevent such illicit intrusions.

The web spaces outside the domain of http://www.nowa.market , in particular, the spaces to which the user may be directed by means of hypertext links are the sole responsibility of the owners of these web spaces.

13. Personal data
NOWA MARKET complies with the Belgian law of 8 December 1992, as amended, on the processing of personal data. The customer has the right to access, modify, rectify and delete data concerning him/her by contacting Nowa Market.
NOWA MARKET may contact its customers by e-mail, post or telephone as part of marketing campaigns or satisfaction surveys. 
NOWA MARKET undertakes not to communicate the details of its customers to a third party without prior agreement.

14. Intellectual property rights
The name and logo of NOWA MARKET as well as those of the companies listed on the website are protected names and trademarks. The intellectual property rights of the website are the exclusive property of NOWA MARKET or its contractors. The information on the website may not be made public, reproduced or modified without the prior written consent of NOWA MARKET, except for strictly personal use.

15. Delivery of alcoholic products
When ordering alcoholic products from NOWA MARKET, additional requirements apply. In order for NOWA MARKET to ensure that you are at least 18 years old at the time of delivery of your order, we are required to verify your age and may not deliver your order elsewhere. Our delivery service will carry out this check for us and will ask for valid identification (an ID card, passport or driving licence). The age check applies up to the age of 25 and is at the discretion of the delivery person.
