Terms and Conditions of Sale (TCS) - Nowa Market

1. Access to the website and acceptance of the TCS

Access to and use of thewww.nowa.market website are subject to these Terms and Conditions of Sale (TCS). Customers must carefully read and accept these terms before placing any order.

3. Purpose

Nowa Market offers healthy and organic products for online sale. Customers select products on the website, add them to their cart, accept these terms, and proceed to payment using the available methods. An order confirmation email marks the conclusion of the sales contract. Nowa Market may request additional information or refuse an order, particularly in cases of an existing dispute, obvious error, or stock shortage. Only legally capable individuals may place an order.

4. Application and acceptance of the TCS

The product and service features are clearly indicated on the website. Placing an order constitutes full and irrevocable acceptance of these terms, which are available at all times on the site and sent with the order confirmation.

5. Fees, delivery, and payment

Delivery fees are clearly displayed before the order is confirmed. Nowa Market delivers within Belgium within a maximum of 4 working days, except in cases of force majeure. Customers must inspect their order upon delivery and report any issue to the courier or pickup point. If absent, the order may be delivered to a designated pickup point.

6. Prices and site information

All prices include VAT and may be modified at any time, except for already confirmed orders. Product descriptions and images are indicative and not contractually binding.

7. Orders

Customers must create an account to place an order. Orders are only final once payment is completed. Nowa Market may cancel any order in case of prior payment issues.

8. Deposit system

Nowa Market uses a deposit system for its reusable packaging. No refund will be issued for broken packaging or if the QR code is missing or unreadable. Deposits must be returned at pickup points, to the delivery driver, or during a dedicated collection round within one year of the last order delivered to one of the chosen pickup points.

9. Right of withdrawal and returns

According to Article VI.53 of the Belgian Code of Economic Law, the 14-day withdrawal period does not apply to goods that may spoil quickly or are perishable (e.g. fresh food).
For eligible products, customers have 14 calendar days from receipt to exercise their right of withdrawal. Returned products must be unopened and unused. Return shipping costs are borne by the customer. Refunds are processed within 14 days of receipt of the returned products.

10. Product conformity

Nowa Market guarantees the quality and conformity of its products. Any visible defect must be reported immediately upon receipt.

11. Liability

Nowa Market cannot be held liable for improper use of products or for any changes made by manufacturers. Liability is limited to the total amount of the order. Nowa Market is not responsible for presentation errors or indirect/unforeseeable damages. Product descriptions and photos are indicative only. Customers must consult the manufacturer's instructions included with the product.

12. Personal data

Nowa Market complies with the Belgian law of December 8, 1992, on the processing of personal data, as amended. Customers have the right to access, modify, correct, or delete their data by contacting Nowa Market. Personal data will never be shared with third parties without prior consent.

13. Organic label and product usage

Nowa Market is certified organic (control body: BE-BIO-01). Products are not intended for resale by businesses. The organic certification is non-transferable and does not extend to any company reselling or transforming these products.

14. Intellectual property rights

The name and logo of Nowa Market, as well as the trademarks on the website, are protected. No content from the site may be published, reproduced, or modified without prior written consent from Nowa Market, except for personal use.

15. Miscellaneous

If one clause of these TCS is deemed invalid, the other provisions remain unaffected. Any failure by Nowa Market to enforce a clause shall not be deemed a waiver of its rights. Nowa Market shall not be held liable for force majeure events (war, strike, natural disaster, etc.). In such cases, orders will be delivered within a maximum of 60 days. Beyond this timeframe, customers may cancel their order.
Any dispute is governed by Belgian law. Only the courts of Brussels shall have jurisdiction. Disputes may also be reported via the European ODR platform:
